OPINION: Who's in the wrong here?

Hey all firstly I'd like to say that this forum has taught so much about XT's and I would not have noticed this problem in the first place if it wasn't for the threads and discussions that I have read here on the XT forum. So a big thanks from me to all you guys over the years who have dedicated time researching these bikes.

About 5-6 months ago I started looking for a new bike since my previous one got bought by the insurance company after i'd fallen with it. Particularly what drew my attention was ofcourse XT's. After some basic research about the bike, not anything really in-depth stuff, I decided this is the bike I want. Yamaha XT660 X.

The snow had melted for the most part and there was this one 2008 XT I had my eye on. It was a store that sells your basic motorvehicular needs, parts and maintenance stuff, snowmobiles, ATV's and a few two wheelers, dirtbikes and the occasional motorcycle that they sometimes get in exchange from customers during a sale.

Hooked up the dude that runs the place and we agreed that I'd come and check out the bike. Keep in mind I am at a novice level when it comes to general knowledge about cars and bikes, all mechanical stuff etc. so I took my friend with me who had more knowledge and expertise.

We arrive at the store and the guy gives the basic rundown of the bike. Overall it's in good shape and has only 21 000 km on it and is 2008 which would be 10 years newer than my previous bike so I was stoked about it. Took it for a spin and immediately liked it very much. So we asked a lot about the bike but the guy didn't know really anything about it since he had gotten it in an exchange from a customer a few weeks ago. He only said that it was in "good shape" which it was.. There was no service book to check what had been done to it, no receipts, only 1 key.. Was stoked it had aftermarket exhausts so that was a plus.. we haggled about the price for a good fifteen minutes until i got it to a point that was satisfactory to me considering all the info I had about the bike. So i buy it..

About two months pass and I've only rode it a few hundred Km's because of the cold climate we still have here in the north of Finland. I noticed the surging and cut outs with the bike, didnt really care about it that much at first. Started to read on here about mods and whatnot about a week ago and got into reading pretty much every mod there is to these bikes. Read about the faulty ECU's that had been an issue during -04 and upwards, read about surging issues and how to fix them etc.

Just the other day contacted Kev to order his fuel mod + the o2 controller, which fits XT's with the o2 sensor ('07 -> i believe). Had no worries.. Until I went to the garage to check how to actually install the mods and where the wires went you know so that when I got the mods I would be prepared and would know right then how to set them up. That's when I noticed while checking the ECU that it had the serial number from an '05 - '06 bike. My jaw dropped and I could not believe this so I double checked to see if I had gotten something wrong about the number... nope it in fact was from that time. I confirmed this by looking for the O2 sensor which at the time did not know where was located.. checked google and this forum and could not find it on the bike.

So.. heartbroken knowing I would not be able to get the o2 controller I went and pulled the bikes history from the register. Turns out the bikes been checked the first time during December 2006 but has not been taken into road use until mid 2008.

I then contacted the guy that sold it to me (as an '08) and he said that he couldn't have known that it was in fact the '06 model. He said that these things happen all the time that an older model item is sold to him and by him as a newer, they just put the model stamp on the listing from the year its taken into road use. I tried to explain to him that I want some compensation because the bike that he sold to me and was supposed to be a 2008 was actually 2 years older than what it actually was. He said that it doesn't matter if it's a 2006 or a 2008 model the price stays the same. I got a little bit mad here and a bit upset and told him swiftly just alright bye then and hung up. In my opinion 2 years difference in a motorvehicle does actually affect the total value of it, if not by a lot but some at least.. Don't you?

Went ahead and ordered the Kev's fuel mod from Kev today. Sadly without the o2 controller..




So what do you guys think?
Do you agree with me that I should get some amount of compensation from the price since it's actually 2 years older than it was supposed to?

Or do you think the guy that sold it to me is in the right and I should just suck it up? Looking forward to your guys opinions so I know whether to pursue this or not.

I buy used bike from store owner, 2 months later see it's actually 2 years older than was supposed to. Confront seller he says he didn't know. I ask about compensation, he declines. I want your opinion who's right and who's wrong.

You have to check the consumer protection laws in Finland to see what is what.

It seems to me that the store is in the wrong. And even if you are not legally eligible for some sort of compensation, you might have the right to report him and that threat could get you a compensation. All this I pull out of my arse though. You really should contact the Consumer Protection Agency in Finland to get valid answers.

I'm going to contact the consumer protection agency tomorrow. Also probably going to send a written reclamation to the store aswell.

Gonna update here as soon as i get some answers.

It all depends on two things:-
  1. What is the law in your country
  2. How much you want to stay on good terms with this person

In the UK I believe it is illegal to state the age of a vehicle is younger than it really is. He would also be in breach of at least one consumer law (possibly more).

You can ask for compensation or return the bike and ask for your money back.

Problem is, unless he turns out to be a decent guy, you will have to get legal on his ass.

No one is in the wrong really as it is very very common for early model bikes to be put on a later plate. But when they are sold on the later plate they are still brand new and considered that reg bike so it’s NOT a 2 year older bike you have it’s an early model 2008 reg bike. I just bought a 2007 xt660 but did not notice it was a 2006 till I got it home (02 sensor missing) but does that take anything away from the bike NO .it’s still a 2007 bike and will be sold as a 2007 bike when I sell it,as that is what it is. I also have a 2015 Fz1n and I bought it at one year old thinking it was a 2015 model I got the belly pan painted and the paint code was from a 2010 bike so the bike in fact is a 2010 model again does that make any difference NO it’s still a one year old bike and is still a 2015 plate bike So I would say get over it and enjoy your bike. You liked it when you bought it. So what’s the problem. And bottom line you don’t have a leg to stand on. Just ride the thing and stop trying to get money back apart from the 02 sensor it’s the same bloody bike. The shop sold you a 2008 xt660 and that’s what you got. It maybe an early model but it’s still a 2008 bike and the age go’s from when it was first registered so when the bike was sold in 2008 the bike was not sold as a 2 year old bike it was sold as a new bike and it was.and just so you know I had a 2011 bike with all the mods and the bike still cut out from time to time at speed when dropping down a gear bloody dangerous but hay the xt660 you love them or hate them. If you like your bike just enjoy it the bike was not sold dishonestly the bike was sold as a 2008 reg and it is.

persoanlly, not sure what laws but here in Aust, caveat emptor applies ( buyer beware),

you were probably excited etc and checked the bike and went along and took what he said as being gospel. What i find odd, is that you did the checks after the bike you bought and found out the serial numbers etc. you should have done that before you purchased the bike. hard truth, lesson learnt. the guy may have also been honest etc and henuinely not known.

the surging etc can be fixed and happens to most , common fault. put it in your memory banks for next time, get on the bike and ride. i just purchased another one 2 weeks ago, and i do all checks, stolen, fininace owing, history etc....i would be more worried if you bought it and found the engine was knackered and done over 100K, .
